This website is operated by Sunshine Coffee. Throughout the site, the terms “we,” “us,” and “our” refer to Sunshine Coffee. Sunshine Coffee offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including, without limitation, browsers, customers, and contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

Any new features or tools added to the current store shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1. Who we are

Sunshine Coffee, a société simple (partnership without legal personality) under Belgian law.

2. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence, or that you are the age of majority and you have given us your consent to allow any minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of these Terms may result in the termination of your access to the Services.

3. General conditions

We reserve the right to refuse service to anyone for a legitimate reason, such as suspected fraud or abuse.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service, or any contact on the website through which the Service is provided, without express written permission from us.

Headings in this agreement are for convenience only and do not limit or otherwise affect these Terms.

4. Accuracy of information

We make every effort to keep the information on this site accurate, complete, and current, but we cannot guarantee that it is free of errors. The material on this site is provided for general information. We reserve the right to modify the contents of this site at any time.

5. Products, prices, and availability

Our products are home-compostable coffee capsules compatible with Nespresso® machines. All prices are shown in euros and include taxes. Shipping costs are shown separately and are added at checkout before you pay.

Prices may change at any time, but the price that applies to your order is the one displayed when you place it. Products are offered while stocks last, and a product that is sold out cannot be ordered.

6. Orders and payment

You place an order by adding products to your cart and completing the checkout. Your order is confirmed once your payment has been accepted.

Payments are processed by Stripe, a secure payment provider. The payment methods offered are displayed at checkout. Your card details are entered on Stripe’s secure page and are never stored by us.

7. Delivery

We deliver to Belgium, France, Germany, Luxembourg, and the Netherlands. You choose the delivery country in your cart before paying, and your delivery address must be in that country.

Shipping costs are €3.99 for Belgium and €9.99 for France, Germany, Luxembourg, and the Netherlands. Shipping is free for orders of €50 or more.

We ship your order as soon as possible. Unless a different date is agreed with you, the legal maximum delivery period of 30 days from your order applies.

8. Right of withdrawal

If you are a consumer, you have the right to withdraw from your purchase within 14 days, without giving any reason. The withdrawal period expires 14 days after the day you receive the goods (for a subscription, after the day you receive the first delivery).

To exercise this right, you must tell us clearly that you wish to withdraw, by email to [email protected], before the period expires. You may use any clear statement, and you are not required to use a specific form.

If you withdraw, we will refund all payments received from you, including the standard shipping cost, no later than 14 days after we receive your notice of withdrawal. We may wait until we have received the goods back or you have shown proof that you sent them back. We refund you using the same payment method you used for the order.

You must send the goods back to us without undue delay, and no later than 14 days after telling us of your withdrawal. You bear the direct cost of returning the goods.

Sealed goods that cannot be returned for health protection or hygiene reasons are excluded from the right of withdrawal once you have unsealed them after delivery. Please keep your products unopened if you wish to return them.

9. Subscriptions

A subscription lets you receive your coffee every 4, 8, or 12 weeks, at the frequency you choose, with a 10% discount on the price of the products.

The first payment is taken at checkout. After that, your payment method is charged automatically at each renewal, and a new delivery is sent. Shipping costs apply to each delivery under the same conditions as for a single order, calculated on the amount of the subscription: shipping is free when the amount is €50 or more.

Your subscription renews automatically until you cancel it. You can cancel at any time, without a cancellation fee, from the “Manage my subscription” page of this site (your email address is used to send you a secure link) or by writing to us. A cancellation takes effect for the next renewal. Deliveries already paid for are not refunded, except where the right of withdrawal above applies.

Prices of a subscription may change. Any change applies only to future renewals, and you may cancel your subscription before it takes effect.

10. Legal guarantee and complaints

As a consumer, you benefit from the legal guarantee of conformity applicable to goods sold in the European Union. If a product you received is damaged, defective, or does not match your order, please contact us at [email protected] with your order details and, if possible, a photo, and we will find a solution with you.

If we cannot resolve a complaint together, you may contact the Belgian Consumer Mediation Service (www.mediationconsommateur.be).

11. Intellectual property

The content of this site, including texts, images, logos, and product designs, belongs to Sunshine Coffee or is used with permission. It may not be copied or reused without our prior written consent.

12. Liability

We shall not be liable for any modification, suspension, or discontinuance of the website or the Service. Nothing in these Terms limits or excludes the rights you have as a consumer under mandatory law, or any liability that cannot be limited or excluded by law.

13. Governing law

These Terms are governed by Belgian law. If you are a consumer, you also benefit from the mandatory consumer protection rules of the country where you live.
